This dog is being sold as companion animal only (Unless otherwise stated in this document).
Terms:
This dog is not being sold under co-ownership terms. Payment includes a $______ non-refundable deposit to hold the dog, which will be applied to the buyers total upon pickup of the dog. Once the dog is ready to be picked up the remainder of the balance is due in full before the dog and any paper work is to be released to the Buyer. Buyers who opt to have their puppy delivered or shipped will be required to pay balance in full at least two weeks prior to delivery with all payments being final. Payment options include Cash, Credit Card, and PayPal via invoice.
Health Guarantee:
The Seller certifies that upon receipt, the dog is in good health and has been vaccinated and immunized per the veterinarian recommended shots for a dog of its age. The Buyer agrees to have the dog examined by a licensed and registered veterinarian, at the Buyers expense, within 48 business hours of purchase. If the veterinarian does not give the dog a clean bill of health, the Buyer must notify the Seller immediately. The Seller reserves the right, at that time, to have the dog re-examined by the Sellers veterinarian at the Sellers expense. If the dog is found not to be in good condition, through no fault of the buyer, the Seller will offer a full refund minus any shipping or delivery costs, once the dog is returned to the Seller (At Buyers Expense).
Any condition that is a minor, correctable, or breed related minor condition is not covered under the Health Guarantee and conditions which could go away, or are considered to be conditions which a puppy will likely grow out of are also not covered. Seller does not assume any responsibility for contagious diseases diagnosed after 3 days from date of purchase.
The Seller guarantees the dog to be free of major breed specific health problems for a period of Six (6) months from the date of purchase. If the dog is diagnosed with a major breed specific health problem by a licensed and registered veterinarian the Buyer must notify the Seller immediately. The Seller reserves the right at that time to have the dog re-examined by the Sellers veterinarian at the Sellers expense. Any condition that is a minor, correctable, breed related minor condition is not covered and conditions which could go away, or are considered to be conditions which a puppy will likely grow out of are also not covered. If the dog is then found not to be in good health, Seller will resume possession of the dog (at the Buyers expense). A full refund of the Buyers purchase price minus a 10% administration fee and any shipping or delivery charges will be returned to the Buyer once the dog is returned to the Seller.
Finally, the Seller does not guarantee the vaccinations that the puppy has been vaccinated against only that they have been administered in accordance with suggested guidelines up to date of transfer of ownership. If the puppy contracts any of the diseases he/she has been vaccinated against the Buyer assumes full responsibility for any medical cost and the Seller is not liable. Seller also does not assume any responsibility for any conditions related to or stemming from shipping or delivery. Shipping or delivery to include, but not limited to, any person taking possession of a puppy from the Seller. Any agent of the Buyer to include the Buyer, who is designated to assume possession of any puppy, will be required to sign a release of liability if a puppy is to be transferred to someone other than the Buyer. (Normal shipping situations, where a shipping company is used routinely, is not included in the previous requirement.)
Buyer Agreement:
This dog is sold with limited registration.
This dog must be spayed or neutered and proof of procedure provided to Seller prior to Registration being transferred to Buyer. Buyer must have procedure performed on the dog by the time the dog is Six (6) months old to prevent any unwanted and unregistered litters. In the event the Buyer is unable to keep this dog for any reason, the Buyer agrees to offer to the Seller the first chance to take this dog back. In the event of a re-sale the Buyer must notify the Seller with the new name and address of the new buyer. Buyer agrees not to sell this dog to any retail company or establishment.
Any changes to this contract must be in writing and signed by both parties. This contract is legal and may be enforced by legal means at the buyer’s expense and all disputes must be settled in the state of OKLAHOMA. This dog is sold to you as a pet only and nothing further unless specified otherwise in this contract.
